TERMS & CONDITIONS
Terms of Payment, Legal Fees & Disputes: Payment is due when invoices are received unless credit terms have been extended in writing by an authorised representative of Car Wrapping Perth. After 30 days, unpaid invoices are Past Due, and all present and future jobs may be put on hold until the old balance is paid. After 60 days, the account is considered delinquent and may be placed in collections. Balances unpaid after 60 days will incur interest at 1.5% per month. Expenses incidental to display, including court costs, fees, expenses and reasonable attorney(s) fees, will also be charged to any account placed with our collection service. Clients shall identify any dispute concerning an invoice to Star Tint in writing within ten days of the invoice date. The Client has accepted the invoice if arguments are not specified in writing. Clients must return any work in conflict to Star Tint accompanied by a written explanation. After investigation, errors on our behalf will be corrected or credited to the Client’s account.
We cannot accept responsibility for consequential damages or loss from the sale, installation, printing, or delivery of our products. The client is responsible for reading our FAQ page on our website before contracting Star Tint to do any work. All quotations are valid for 15 days.
PAYMENT TERMS: A deposit of $1000 as a deposit is required at the time of placing an order for a Car Wrap. The balance is due before the job leaves our building.
RETURNS: All of the products offered by Star Tint are custom-made projects that are not refundable. If the client has a concern with the job, the Client will need to contact Star Tint in writing before proceeding with any chargebacks or credit returns. Star Tint will be allowed to resolve disputes within 30 days by fixing the disputed project. Since all jobs are custom products, Star Tint must be allowed to reprint or reinstall any position before the client issues any credit card chargebacks or returns. If the client issues a credit card chargeback or alleges they did not authorise the credit card transaction, the credit card company will give an inquiry. When the credit company investigates the claim and if the credit card company’s decision is made in favour of Car Wrapping Perth, the client will be held liable for all legal fees and professional research and discovery time associated with Star Tint having to file an Inquiry with the credit card company.
If a credit card dispute is decided in favour of Star Tint and if Star Tint suffers any loss of credit card business associated with a client’s chargeback request, the client will be liable for all legal fees, and any credit card business Star Tint is not able to process during this period of the dispute resolution. Suppose the customer fails to make payment in full on the job invoice. In that case, the customer irrevocably authorises Star Tint to remove the graphics supplied or take back any produced products.
Since this is custom artwork…once the job is printed, delivered and or installed, all contracts are final, and no monetary refunds can be issued. STORE CREDIT ONLY!
ESTIMATES & TAXES: Estimates are reasonable faith estimates based on job specification information provided by the client and current material costs. Pricing and schedule are subject to change upon receipt of artwork and approval of estimate. Pricing is good for 15 days from the date of the quote and does not include packaging or shipping charges unless specified. Estimates are contingent upon strikes, accidents, fire, availability of materials and all other causes beyond our control. Star Tint requires a 50% deposit upon approval of the estimate and 50% upon delivery based on the terms we agreed on unless you’ve negotiated it. The Client order is subject to applicable state and local taxes.
JOB CANCELLATION & ERRORS: If the Client cancels the order before its completion, the Client shall be responsible for the cost of any proofs, artwork, materials re-stocking and work performed until cancellation notice is received in writing. In addition, Star Tint reserves the right to charge a 20% cancellation charge in addition to the actual charges to cover un-billed internal costs, including scheduling, client communications and resources utilised. Star Tint will gladly re-image any job that has problems due to an error on the part of Car Wrapping Perth. This does not include software limitations or the client’s improper job setup. Star Tint will not be held responsible for errors in work after final client Approval or neglect of final approval. No claims will be honoured after 24 hours of completion and delivery of the work receipt.
Verbal orders will be accepted, but Star Tint will not be responsible for verbal mistakes. EVERYTHING SHOULD BE IN WRITING. Star Tint will not accept responsibility for the inaccuracies in verbal orders by the customer.
LIMITATION OF LIABILITY & CONFIDENTIALITY: Star Tint will not be responsible in any way for any materials supplied by the client. Original artwork is left at the Client’s risk and is not subject to replacement. Car Wrapping Perth will not assume liability for damaged or lost files.
PROJECT START TIME, SUBSTRATES, & INSTALLATION: The start time of any project begins when ALL support files and items related to the completion of the job are in-house and the Client approves the artwork. Ultimately, the Client accepts full responsibility for determining if said purchased item will meet their requirements on the substrate(s) to which they are applied.
TRADEMARKS & COPYRIGHTS: Reproducing copyrighted materials without the originator’s prior permission is illegal. It is the Client’s responsibility to obtain said permission. Star Tint is not responsible for obtaining consent and assumes that the Client has obtained consent before the work is submitted.
DESIGN & PRINTING: Final Approved methods will become the client’s property once the job is completed and paid for. Star Tint will save your file in native format on your supplied Flash Drive. All other designs and materials used to create the design will remain the property of Car Wrapping Perth. Star Tint will only store artwork for one year. Any design fees associated with re-creating the client’s structure due to the client not having their flash drive will be charged to the client.
Star Tint will not be held responsible for any design layouts the client provides. All original art must come ready to print. There will be a design fee for changes to client-supplied art or structure. The design fee is $75.00 per hour.
ADDITIONAL COLOUR MATCHING AND DESIGN: If the Client’s files exceed the determined file set-up rate included in the price of the project, charges will be based on a rate of $75/hour with a $100 minimum and billed in 15-minute increments after the minimum is met. The Client will be notified of this charge before work starts, and we require Client authorisation before proceeding. If Star Tint is creating original artwork, the design will be billed at $75/hour. Colour matching charges are $100 per hour. Due to the nature of screen and digital printing, we cannot match PMS colours exactly and give no guarantees of precise colour matches. A +/- of 3% to 5% variation is acceptable industry-wide.
Use of Images and References to Completed Work: At its sole discretion, Star Tint may use images of completed work and refer to the Client in Car Wrapping Perth’s portfolio and any other marketing materials.
The client is responsible for providing or purchasing quality, high-resolution pictures for large-format printing. Star Tint will not be held accountable for low-resolution images supplied by the client for printing.
Vehicle Wrap: Additional Terms, Conditions and Warranty Disclaimer:
INSTALLATIONS: Star Tint only guarantees final prints designed and set up by Star Tint. Star Tint reserves the right to VOID the warranty on any same-day photo and install jobs or Rush Jobs. Car Wrapping Perth disclaims all warranties on buses, planes, trains, RVs, custom vehicles and vehicles with OEM paint that is more than six years old. If we are asked to cover existing vinyl decals, we cannot be liable for any damage caused to these decals during the installation or removal process.
A Wrap is NOT paint. There may be extreme curves, deep channels and mouldings on the vehicle that the vinyl cannot conform to. You will see evidence of the vehicle’s original colour in some small areas. These may be small areas such as around door handles and the edges of the lights on the cars. A vehicle wrap is made by applying 52-inch (1520mm)vertical panels of vinyl. There will be 25mm seams where the committees meet. On a complex design with many matching points, Star Tint cannot guarantee that the graphics will match 100% alignment due to the complicated curves of the vehicle. A 5% margin is considered acceptable on sizeable outdoor advertising projects.
Proofs are created on a flat surface and viewed at a relatively tiny size on computer screens and printed paper. In curves, handles, deep grooves, and rubber mouldings/trim cases, the installer may make on-the-spot adjustments to assure maximum readability or alignment. In many cases, there are slight differences between the printed flat paper proof and the 3-dimensional curved vehicle wrap. This can vary up to several inches. This is normal, and the wrap needs to be designed with this in mind.
It is unreasonable to expect printed vinyl wrap to cover and look precisely like paint or look the same in all the same places. A piece of vinyl has limits and can only stretch so much before it changes colour. In some cases, a relief cut may have to be made into the vinyl that will reveal a small amount of the original vehicle’s paint colour under the vinyl. Sometimes, a patch must be installed to conceal the vehicle’s colour. It is the only option. Areas under door handles, mirrors, behind gas caps, and inside door frames will not be wrapped. If we cover Extremely curved surfaces such as mirrors and bumpers, they may reveal the original paint colour at the tight edges of the wrap. It has more to do with material limitations and not install quality. Star Tint cannot warranty those areas with extreme curves. It is the client’s sole risk if they choose to wrap mirrors or other very tight turns. Star Tint will inform the client of these areas before we begin the design.
Suitable conditions must exist if we install at the client’s nominated location. Vehicles must be indoors, in a clean, dust-free, temperature-controlled environment, with a power supply and good quality lighting with a minimum of 1-metre working space around the entire vehicle. Suppose, in the opinion of the senior installer on site, conditions are not suitable for a high-quality install of the wrap. In that case, the car must go to one of our nominated install locations. Wraps are self-adhesive vinyl that will only adhere well to catalysed vehicle paint and glass. Poor surface paint or clear coats will prevent the vinyl adhesive from sticking correctly, and the bond may fail. The vehicle owner is responsible for bringing in a vehicle that is ready to be wrapped. Extreme curves and deep pockets may exceed how far the material can stretch. Again, this is not paint. It is a unique pressure-sensitive vinyl material. Vehicles are not at exact right angle curves. They maintain lines that are not 100% parallel to the ground. Due to this fact, the 2D printed graphics will not be at the same angle as the vehicle lines once the wrap is installed onto the 3D vehicle surface.
Due to the limitations and sensitivity of various substrates, it is impossible to reproduce all colours accurately. Therefore, in the absence of a representative from your company to select the appropriate colour sample, reproduction will be at our discretion. When we wrap over existing vinyl strips or letters, the new wrap is so thin that there will be evidence of old vinyl underneath the new vinyl. Star Tint will not be held responsible for any damage, void of vehicle warranty or anything caused by applying the vinyl products. Car Wrapping Perth is not liable if the car’s clear coat begins to peel off during the installation of a wrap. Original-painted vehicles should not have problems with the clear skin peeling off.
The application process often takes up to a day or two. Full and partial wraps can be done within one day. It is not a good idea to rush the installation process, as many things can go wrong. Star Tint will not be held responsible for any damage caused to the vehicle during the installation process. The client is responsible for inspecting the car before and after installation. Star Tint will not be held accountable for any damage caused to the vehicle during installation.
WARRANTY: Star Tint offers a limited warranty on the installation of the wrap. The warranty covers the wrap structure for one year from the installation date. This warranty does not cover damage caused by accidents, misuse, abuse, or regular wear and tear. The contract also does not cover any damage caused by the wrap removal. If the wrap is damaged in any way, Car Wrapping Perth will not be responsible for the repair or replacement of the wrap. The client is responsible for the cost of any repairs or replacements.
REMOVAL: Star Tint is not responsible for any damage caused during the wrap removal. The client is responsible for removing the wrap at their own risk. Star Tint will not be held liable for any damage caused during the removal process, and Star Tint DOES NOT REMOVE WRAPS.
LIMITATION OF LIABILITY: Star Tint’s liability for any claim, loss, damage, or injury arising out of the performance or breach of this agreement or from the design, sale, installation, or use of any product covered by or furnished under this agreement, shall in no case exceed the price allocable to the product or service which gives rise to the claim, loss, damage, or injury. In no event shall Car Wrapping Perth be liable for special, indirect, incidental, or consequential damages, whether in contract, tort, negligence, strict liability, or otherwise, including without limitation damages for injury to person or property, lost profits or revenue, lost sales or loss of use of any product.
GOVERNING LAW: This agreement shall be governed by and construed by the laws of Western Australia, where Star Tint is located. Any disputes arising from this agreement shall be resolved in that state’s courts.
ENTIRE AGREEMENT: This agreement contains the whole agreement between the parties and supersedes all prior negotiations, understandings, and agreements between the parties. No change, modification, or waiver of any of the terms of this agreement shall be effective unless in writing and signed by both parties.
